This website is owned and operated by Maternico, an independent design house established in Portugal, dedicated to creating premium maternity and motherhood
essentials.
These Terms of Use apply to all visitors of the website and to every purchase made through it. The terms are governed by European consumer law and any
applicable local regulations.

images, logos, designs, videos and other graphical or technical material - is
the property of Maternico or is used under licence. No part of the website
content may be copied, reproduced, published, distributed or used without our
prior written consent.
2.2 Registered Designs and Intellectual Property Rights

Certain Maternico products are protected under registered design rights and/or pending design applications within the European Union and other jurisdictions.

Any reproduction, imitation, or commercial use of these protected designs without prior written consent from Maternico is strictly prohibited and may constitute an infringement of intellectual property laws.

Maternico reserves all rights to take legal action against unauthorized use or reproduction of its registered or pending designs.

3. Use of the Website and Acceptable Conduct

The website is provided for information and
purchasing purposes only. You must not use the site for fraudulent activities,
to infringe third-party rights, to place unauthorised commercial
advertisements, or for any other unlawful purpose. Maternico reserves the right, at its sole discretion, to limit, suspend or terminate access to the website or services in the event of a breach of these Terms or suspected fraudulent behaviour.

4. Accounts
and Security

You are responsible for keeping your account
details confidential (including passwords) and for all activity conducted via

5. Prices and
Payments

Prices on the website are displayed in accordance
with our pricing policy (default currency: EUR) unless expressly stated otherwise. Prices may change and Maternico reserves the right to amend prices or cancel orders in the event of a pricing error; in such cases, any sums
already paid will be refunded.

6. Shipping -
Geographic Scope and Procedures

Maternico ships its products to customers worldwide. Details of shipping costs, local taxes (where applicable), estimated
delivery times and any specific conditions are presented on the checkout page and in our [Delivery & Returns Policy]. These terms apply in
accordance with the relevant local consumer law applicable to each customer.

Taxes, Duties
and Import Fees

Orders shipped outside the European Union may be subject to import taxes, customs duties or local taxes in the destination
country. Such charges are the responsibility of the customer and are not included in the product price or shipping fees. Maternico does not control these charges and cannot be held responsible for any delays arising from customs clearance procedures.

Uncollected
Shipments

In the event that a customer does not collect a parcel, Maternico reserves the right to charge an additional handling fee corresponding to the reasonable costs incurred by the company due to non-collection. The applicable charge will be made available in our [Delivery
& Returns Policy].

7. Exchanges,
Returns and Cancellations

7.1 Right to
Cancel / Return Period

Customers in the European Union have the right to cancel their purchase within 30 calendar days of receipt of the goods, in accordance with applicable EU consumer law. For customers outside the
European Union, returns are handled in accordance with the policy detailed on our site and the local law that applies.

7.2 Condition
of Returned Items

Returns are accepted only where the product and
its packaging are in perfect condition, show no signs of use, and include all original labels and accessories. Items that were sold sealed for hygiene reasons and have been opened cannot be returned.

7.2.1 Returns
for Sets or Multi-Item Products

Products sold as complete systems or sets (including multi-part pillows) must be returned in their entirety, in their original packaging and unused. Partial returns of a single component will only be accepted with prior written approval from Maternico.

7.3 How to Return an Item

with your order number, product details and a brief description of the reason for return. We will then provide you with the return instructions. Return shipping costs are borne by the customer unless otherwise stated (for example,
in the case of a faulty product as set out below).

7.4 Faulty or
Non-Conforming Products

If you receive a product that is faulty, missing
components, or does not conform to the description, you must notify us
immediately and in any event no later than 7 days from receipt at hello@maternico.com,
including a photo and description of the issue. In such cases Maternico will
cover return shipping costs and will offer a remedy - repair or replacement; if repair or replacement is impracticable, we will provide an appropriate remedy
in accordance with the applicable law (which may include a refund).

7.5 Processing
Returns and Refunds

Once the returned item is received and inspected
at our warehouse, the exchange or return will be processed within 7 business
days. Any refund due will be issued to the original payment method within a
maximum of 14 days from the date the return is approved, unless
otherwise required by applicable law.

7.6 Decrease in Value

If a returned item has been used in a manner that significantly reduces its value, Maternico reserves the right to deduct an amount reflecting that reduction from the refund, in accordance with applicable
law.

8. Product Warranty and Defects

1. Legal Warranty
   
   The legal warranty for Maternico products is governed by applicable
   European consumer protection law. Customers outside the European Union will be offered remedies in accordance with Maternico’s policies and the
   local law that applies.

2. Remedies
   for Non-Conformity or Defects
   
   In the event of non-conformity or a defect, Maternico will offer an
   appropriate remedy, at our discretion and in accordance with the applicable law - for example, repair, replacement or refund.

3. Warranty
   Exclusions
   
   The warranty will not apply in cases of: improper use or treatment contrary to the product instructions; normal wear and tear; damage due to
   negligence, accident or exposure to harmful substances; unauthorised
   modification or repair by third parties; removal of labels or opening of seals; or purely cosmetic damage that does not affect the product’s
   function.

9. Safety Instructions and Responsible Use

1. All Maternico products are intended for use under active and continuous
   adult supervision.

2. The pillow, in any position, is not intended for infant or child sleep and is not a safe sleeping surface; do not place a baby to sleep on or with the pillow.

3. Do not leave the pillow unattended in a crib, playpen or any other sleep surface.

4. Do not use the pillow while standing; standing while using the pillow presents a
   fall risk.

5. Always ensure the baby’s airway is unobstructed -
   the infant’s head should be visible and their face unobstructed.

6. Do not allow snaps, fastenings or other attachments to be used as toys.

Use of our products is at the customer’s own risk; Maternico is not responsible for damage resulting from use contrary to these instructions.

10.Restriction of Access / Refusal of Service

Maternico reserves the right, at its sole
discretion, to limit or refuse access to the website, to suspend accounts, to
cancel or decline suspicious orders, or to prevent unlawful or harmful use. If an order is cancelled after payment, refunds will be processed in accordance
with section 7.

11. ThirdParties and Payment Services

Payments on the website are processed securely via Shopify Payments or other third-party payment providers. Payment processing is handled directly by those providers in accordance with their terms and privacy policies. Maternico does not store and does not have access to customers’ full credit card details at any stage of the transaction.

The website also uses third-party tools and services (such as analytics systems and advertising pixels) to operate, measure and improve the user experience. Use of these tools is subject to the providers’ respective terms; Maternico is not responsible for technical issues, delays or policy breaches by third parties beyond what is required by law.

13. Force Majeure

Maternico will not be liable for failure to perform its obligations where such failure is due to events beyond its
reasonable control, including natural disasters, acts of war, pandemics,widespread strikes, major technical failures, or regulatory actions that require suspension.

14. Changes to the Terms

Maternico reserves the right to update these Terms of Use from time to time. It is the user’s responsibility to review the
Terms periodically; continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms.

15. Governing Law, Jurisdiction and Dispute Resolution

These Terms of Use are governed by the laws of Portugal
and by the applicable European consumer protection rules. In the event of a dispute between a customer and Maternico, we will endeavour to resolve the matter by direct communication. Where appropriate and available, alternative dispute resolution (ADR) mechanisms, including consumer dispute bodies in the
European Union, may be used prior to litigation. Failing resolution, the competent courts of Portugal shall have exclusive jurisdiction, subject to any mandatory consumer protections under local law.

16.Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full forceand effect.
